To sell legally you need: a trade license, CPSR from a qualified assessor (5 000-15 000 CZK), GMP documentation, PIF file and CPNP notification. The regulation is the same for all producers regardless of sales volume.

Want to sell soap that you make at home? Then you need to know the rules. Making it at home for your own use and giving it to friends is one thing - selling it, even if it's just at a farmers market or through a Facebook group, is another. EU and Czech legislation classifies soap (and any other product intended to come into contact with the skin) as cosmetic product, and cosmetic products are covered by a regulatory framework that was originally designed for large manufacturers.

The good news: small artisan producers are fully capable of meeting this framework. It takes time, a little money and an understanding of the process. This page will give you an accurate overview of what you need - in the Czech context, with up-to-date information for 2026.

Legal notice: This site is informational and educational. It does not constitute legal advice. For your specific situation, we recommend consulting a cosmetics regulation expert or a lawyer specialising in EU law.

Basic legislative framework

What regulation applies to soap?

Regulation (EC) No 1223/2009 is the basic law. All cosmetics sold in the EU are governed by Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products (hereinafter referred to as the "Regulation“). This Regulation applies directly in all EU countries - there is no need to rewrite it into Czech law, it applies as a whole.

What Regulation says about your soap:

Every cosmetic product must have Responsible person (Responsible Person) - a natural or legal person established in the EU who is responsible for security and compliance with the Regulation

For each preparation there must be PIF (Product Information File)

Each preparation must have CPSR (Cosmetic Product Safety Report) prepared by a qualified person

Each preparation must be notified in CPNP (Cosmetic Products Notification Portal) before placing on the market

The product must be labelled according to Article 19 of the Regulation (INCI list, best before date, LOT number, etc.)

Production must comply with GMP (Good Manufacturing Practices) according to ISO 22716

Sounds complicated. Let's break it down step by step.

Step 1: Do I need a trade certificate?

What is a trade licence and how to obtain one

You need a business license before you can sell cosmetics. To sell legally, you must have an official licence. For the manufacture and sale of cosmetics in the Czech Republic free trade - no special training or exams are required.

How to obtain a trade licence:

Visit your local Trade Licensing Office (or use the online form at czu.cz)

Ask for free trade with the subject of business: 'Manufacture of cosmetic products“

Pay the administrative fee: 1 000 CZK (first notification), 500 CZK (other branches)

The trade licence commences on the date of notification (or such later date as you may specify)

Alternative: s.r.o. - For larger manufacturers or if you want to separate personal and business liabilities, an LLC is appropriate. For small manufacturers starting out, a sole proprietorship is easier.

Tax liability: The sale of cosmetics is income subject to income tax. If your annual turnover exceeds CZK 2,000,000, you become a VAT payer. Below this turnover you are a non-taxpayer.

Step 2: What are the minimum standards for manufacturing (GMP)?

What is GMP and what does it mean for a small producer

GMP (Good Manufacturing Practice) defines minimum standards for the manufacture, storage, control and distribution of cosmetics. In the EU, GMP for cosmetics is defined by the standard ISO 22716:2007.

What GMP requires for a small manufacturer:

Production facilities: Clean, separate from housing, or at least clearly defined, easily cleanable surfaces. You don't need to have an industrial hall - but production on a kitchen table shared with food can be problematic when audited. Ideally a separate room or part of a space dedicated solely to production.

Documentation of the production process: You keep records for each batch:

Date of manufacture

Lot number (LOT)

Quantity and batch of each ingredient

Production conditions (temperature)

Control results (pH, visual inspection)

Name of the person who produced the batch

Material documentation: Safety Data Sheets (SDS) for all ingredients, certificates from suppliers.

Traceability: Ability to trace back each batch - what was used, when, in what quantity.

Handy Tip: Create a simple spreadsheet in Excel or Google Sheets with fields for: date, LOT number, ingredients (name, supplier, supplier batch, quantity), manufacturing process, pH control, notes. This is the basis of your GMP documentation.

Step 3: What is CPSR and why do I need it?

Why the CPSR is the most important document

This is the most important and costly step. A CPSR (Cosmetic Product Safety Report) is a professional report that proves your product is safe for its intended use.

What the CPSR contains

The CPSR is a two-part document (according to Annex I of the Regulation):

Part A - Safety information:

Quantitative and qualitative composition (each ingredient + quantity)

Physical and chemical properties and stability

Microbiological quality

Impurities and trace amounts

Information on packaging material

Normal and reasonably foreseeable use

Exposure to the product (how, where, how long)

Exposure to individual substances (calculation)

Toxicological profile of each substance

Side effects and serious side effects

Information on the cosmetic product (clinical trials, if any)

Part B - Safety assessment:

Conclusions of the evaluation

Markings and warnings

Justification for the safety assessment

Qualification of safety assessor

Who compiles the CPSR?

The CPSR must process safety assessor (Safety Assessor) - a person with at least a bachelor's degree in pharmacy, toxicology, medicine, biochemistry or a related field (according to Article 10 of the Regulation).

As a small producer, you order your CPSR from an accredited company.

Where to order CPSR in the Czech Republic?

There are several companies providing CPSR and regulatory services for cosmetics in the Czech Republic. Indicative prices vary according to the complexity of the product:

Simple soap (3-6 ingredients, without declared skincare claims): 5 000-9 000 CZK

A more complex preparation (10-15 ingredients, perfume): 9 000-15 000 CZK

Large batch of products at once (package deals): better value for money

Before selecting a supplier, check: whether the safety assessor meets the qualification requirements of Article 10 of the Regulation, references from other small manufacturers, experience with soap and natural cosmetics.

Search: keywords "CPSR cosmetics CR“, "cosmetic product safety report“, "regulatory services cosmetics Praha“ - the current list of suppliers is changing rapidly, therefore we do not recommend specific companies, but we recommend checking the currency of references.

How long is the CPSR valid?

The CPSR does not have a statutory period of validity but must reflect the current composition. If you change the recipe (different supplier, different ingredients, different quantities), the CPSR needs to be updated.

Step 4: What is PIF and where do I get it?

How to collect the mandatory documentation

The PIF is a folder of documents that you must have for every product on the market. It's a file, not a form - so you collect existing documents.

What the PIF contains (according to Annex I of the Regulation):

Description of the cosmetic product (name, function, target users)

CPSR (full document)

Description of the manufacturing method and GMP declaration of compliance

Evidence of claimed effects (if the product declares specific effects)

Adverse reaction data (you must monitor and record customer complaints)

Where to keep the PIF: Electronically or physically accessible to the competent authorities for 10 years after the last batch of the product.

PIF language: Czech or English (or another language accepted by the Czech KHS/SÚKL).

Step 5: How to notify in CPNP?

How to register in the EU database

Before you place a product on the EU market for the first time, you must notify the CPNP (Cosmetic Products Notification Portal) - a free EU cosmetics database managed by the European Commission.

How to notify

Register at ec.europa.eu/growth/tools-databases/cosing (CPNP)

Notification is performed by Responsible person - for a small Czech manufacturer, it is most often you yourself (if you are self-employed and based in the Czech Republic and sell in the EU)

Fill in the form: product name, category, composition, manufacturer, Responsible person

Disclose: after sending a notification, you will receive a notification number

Notification is free. It does not require approval - it is a mandatory notification procedure, not a permit.

Step 6: What should the label look like?

What information must be on the packaging

The label of each soap must contain:

Mandatory data

Responsible person: Name or business name and address of the Responsible Person in the EU. If you are a producer-entity in the Czech Republic, this is your name and address.

Volume or weight: Net weight in grams (for solid soap). Example: '100 g net“ or '100 g e“. If the product contains less than 20 g or 20 ml, the weight need not be indicated.

Best before date or PAO:

Preparations with a shelf life of up to 30 months: date "Best if used by...“ (horsetail icon + MM/YYYY or DD/MM/YYYYY)

Products with a shelf-life of more than 30 months: they do not need to have an expiry date, but must have a PAO (Period After Opening - symbol of an open jar with a number of months, e.g. "12M“ = 12 months after opening)

LOT number: Batch number (for traceability). Standard format: LOT + YYYYMMDD or custom numbering.

Functions of the product: If not obvious from the presentation - for soap just "soap“ or "soap bar“.

INCI list: Full list of all ingredients in descending order of quantity (ingredients below 1% can be in any order). Names must be in INCI (International Nomenclature of Cosmetic Ingredients) - Latin or international scientific name.

Note: If the product contains substances requiring special warnings (natural allergens in essential oils, etc.) - mandatory indication on the label.

Language: In the Czech market, all mandatory information must be in Czech (or Slovak - mutual language intelligibility is recognised).

How to list ingredients correctly

Why INCI list and what name to use

The INCI list is probably the most common mistake made by novice manufacturers.

Correct procedure:

Find each ingredient in the INCI database - Cosmetics Ingredient Database (CosIng) at ec.europa.eu

For soap: saponified fats are listed in the INCI as fatty acid salts - SODIUM OLIVATE (olive oil), SODIUM COCOATE (coconut oil), SODIUM TALLOWATE (beef tallow), SODIUM PALMATE (palm oil)

Glycerine resulting from saponification is referred to as GLYCERINE

Water as AQUA

Added ingredients: parfum (perfume, perfume composition), essential oils with their INCI name (LAVANDULA ANGUSTIFOLIA FLOWER OIL for lavender), colorants (CI + number)

INCI example for simple Castilian soap:

SODIUM OLIVATE, AQUA, GLYCERIN

INCI example for soap with coconut oil, olive oil, lavender and white clay:

SODIUM COCOATE, SODIUM OLIVATE, AQUA, GLYCERIN, LAVANDULA ANGUSTIFOLIA FLOWER OIL, KAOLIN

Ranking: SODIUM COCOATE comes first if the coconut makes up the largest proportion of the fat component.

Specific situations

Selling at the farmers' market - do the same rules apply?

Selling on the farmers' market, within the Czech Republic, is still selling cosmetics on the EU market and all the rules described above apply. There is no exception for "small markets“ or "handmakers“.

In practice, however, the inspection authorities (KHS, SÚKL, Czech Trade Inspection) primarily target registered e-shops and large manufacturers. The risk of an inspection on a small market is low - but it is your risk and your responsibility as a seller.

Indicative timetable and costs

How long does it take and how much does it cost?

For the first producer (one or two preparations)

Step

Time

Cost

Trade certificate

1-5 days

1 000 CZK

GMP documentation (creation)

2–4 weeks

0 CZK (own work) or 3-8 000 CZK (consultant)

CPSR

4-8 weeks

5 000-15 000 CZK / preparation

PIF

Ongoing

0 CZK (document collection)

CPNP notifications

1-3 hours

0 Kč

Labels (graphics + print)

1-2 weeks

2 000-10 000 CZK

Total (1 preparation)

2-4 months

~8 000-35 000 CZK

Running costs

CPSR update when prescription is changed: by supplier

Annual overview of PIF documentation: own work

Cosmetics manufacturer insurance: recommended (approx. Sales without CPSR. This is a violation of the Regulation and can lead to fines from the CTIA or KHS, product recalls and civil liability for damages.

2. Marketing claims without basis. "treats eczema“, "removes acne“, "anti-aging“ - these claims go beyond cosmetic claims and enter the realm of health claims (medical devices, regulated otherwise). Cosmetics may claim "cleans“, "conditions“, "refreshes“ - not cures or treats.

3. Incomplete INCI. Forgetting glycerin (a by-product of saponification), water, or substituting the trade name for the INCI name.

4. LOT without record. The LOT number on the label without a corresponding record in the GMP documentation is non-functional - it is not possible to trace back the batch during a complaint or inspection.

5. Obsolete CPSR. Using a CPSR from a time when the recipe was different or from a different raw material supplier.

The journey from first soap to sale

Trade certificate → free trade, production of cosmetic products

GMP documentation → records of batches, production conditions, raw materials

CPSR → order from an accredited evaluator; 4-8 weeks, 5-15 000 CZK

PIF → collect CPSR + GMP records + product description

CPNP notifications → free online, before the first sale

Label → INCI, responsible person, LOT, shelf life, weight

It's extra work compared to home production for pleasure. But for those who want to sell legally and build a serious microbusiness, it's a necessary foundation - and once done, repeating batches of the same recipe is much easier.

Frequently asked questions

Is the regulation of soap different from other cosmetic products? The regulation is the same for all cosmetic products - soap, body care, deodorant. CPSR, PIF and CPNP apply to all. The only difference: the safety evaluation may be easier for a simple soap (fewer ingredients) than for a complex cream.

Can I use CPSR from another manufacturer or importer? No. CPSR is tied to a specific prescription and responsible person. If you order a CPSR from an assessor, they will process it for you and your prescription. Sharing a CPSR between manufacturers without assessor approval is not possible.

What happens if I sell without documentation? Sales without CPSR, PIF or CPNP notification are in breach of Regulation (EC) No 1223/2009. The KHS or customs authorities may carry out an inspection, withdraw the product from the market and impose a fine. The maximum fine can be up to several tens of thousands of CZK. In addition, there is a risk of civil liability for damages if the customer complains.

Do I have to report my soap to the Institute of Health and Consumer Protection or SÚKL? CPNP notifications are registered on a pan-European level. The Czech SÚKL has access to the central CPNP database. No special reporting is needed in the Czech Republic if the notification is in CPNP.

What are the penalties for breach of regulation? Administrative fines for sales without a CPSR can reach tens of thousands of CZK (depending on the state). In the Czech Republic, the maximum fine is set by the Consumer Protection Act. Other consequences are added: withdrawal from the market, ban on sale, civil liability.

How do I check if my Safety Assessor meets the requirements? Verify his/her educational background (diploma in pharmacy, toxicology, medicine, etc.). Ask for references from past clients. Consult soapmakers' associations or previous manufacturers. A legitimate assessor will have no problem providing this information.

See also:

INCI labelling: a detailed guide - how to build a correct INCI list

CPSR and PIF: step by step - detailed documentation guide

Costs and legal production - full costing of legal production

Photos of soap for sale - how to shoot soap for e-shop and social networks

Where to sell homemade soap - farmers markets, Etsy, custom e-shop

This guide was last updated in March 2026.
